Terms of Service

1. Agreement to Terms

By accessing and using the services provided by EcoWild Canada ("Company," "we," "our," or "us"), you ("Customer," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services or website.

2. Description of Services

EcoWild Canada provides eco-tourism services including:

  • Guided wildlife viewing tours
  • Nature hiking and trekking expeditions
  • Marine wildlife watching excursions
  • Northern Lights viewing tours
  • Educational nature programs
  • Photography workshops
  • Custom eco-adventure packages

3. Booking and Payment Terms

3.1 Reservations

All bookings are subject to availability and confirmation by EcoWild Canada. A reservation is not confirmed until you receive written confirmation from us, including tour details and payment instructions.

3.2 Payment

  • A non-refundable deposit of 25% is required to secure your booking
  • Full payment is due 30 days prior to tour departure
  • Bookings made within 30 days of departure require immediate full payment
  • We accept major credit cards and bank transfers
  • All prices are in Canadian dollars (CAD) unless otherwise specified

3.3 Price Changes

Prices are subject to change without notice. Once a booking is confirmed and deposit received, the price is guaranteed except for government-imposed taxes, fees, or surcharges.

4. Cancellation and Refund Policy

4.1 Customer Cancellations

  • More than 60 days before departure: Full refund minus deposit
  • 31-60 days before departure: 50% refund of total amount paid
  • 15-30 days before departure: 25% refund of total amount paid
  • Less than 15 days before departure: No refund

4.2 Company Cancellations

We reserve the right to cancel tours due to:

  • Insufficient enrollment (minimum 4 participants required)
  • Severe weather conditions
  • Safety concerns
  • Force majeure events

In case of company cancellation, you will receive a full refund or credit toward a future tour.

4.3 Weather-Related Cancellations

Tours may be modified or cancelled due to weather conditions for safety reasons. Alternative activities or rescheduling will be offered when possible. No refunds are provided for weather-related modifications.

5. Participant Requirements and Responsibilities

5.1 Health and Fitness

Participants must:

  • Be in good physical health suitable for outdoor activities
  • Disclose any medical conditions that may affect participation
  • Follow all safety instructions provided by guides
  • Inform us of dietary restrictions or allergies

5.2 Age Restrictions

Minimum age requirements vary by tour. Children under 16 must be accompanied by a parent or guardian. Some tours may have specific age restrictions for safety reasons.

5.3 Equipment and Clothing

Participants are responsible for bringing appropriate clothing and personal items. Equipment lists will be provided upon booking confirmation. Some specialized equipment may be available for rent.

6. Safety and Liability

6.1 Assumption of Risk

Outdoor activities involve inherent risks including but not limited to:

  • Wildlife encounters
  • Changing weather conditions
  • Rough terrain and water conditions
  • Equipment failure
  • Risk of injury or illness

By participating, you acknowledge and accept these risks.

6.2 Limitation of Liability

EcoWild Canada's liability is limited to the total amount paid for your tour. We are not liable for:

  • Personal injury, illness, or death
  • Loss or damage to personal property
  • Consequential or indirect damages
  • Acts of nature, weather conditions, or force majeure events
  • Actions of third-party service providers

6.3 Insurance

We strongly recommend that all participants obtain comprehensive travel insurance including medical coverage, trip cancellation, and emergency evacuation.

7. Code of Conduct

All participants must:

  • Respect wildlife and natural environments
  • Follow Leave No Trace principles
  • Comply with all local laws and regulations
  • Treat guides, staff, and other participants with respect
  • Refrain from behavior that endangers themselves or others
  • Not use illegal substances or consume excessive alcohol

We reserve the right to remove participants who violate our code of conduct without refund.

8. Photography and Media

By participating in our tours, you consent to:

  • Being photographed or filmed during activities
  • Use of your likeness in our marketing materials
  • Sharing of photos on our website and social media

Please inform us if you prefer not to be included in photographs or promotional materials.

9. Intellectual Property

All content on our website, including text, images, logos, and designs, is protected by copyright and trademark laws. You may not use our intellectual property without written permission.

10. Privacy Policy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

11. Force Majeure

We are not liable for delays, cancellations, or modifications due to circumstances beyond our control, including:

  • Natural disasters
  • Government actions or travel restrictions
  • Labor strikes or disputes
  • Pandemic or health emergencies
  • Acts of terrorism or war

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of British Columbia, Canada, and any disputes will be resolved in the courts of British Columbia.

12.2 Mediation

Before pursuing legal action, both parties agree to attempt resolution through mediation. If mediation fails, disputes may proceed to binding arbitration or court proceedings.

14. Changes to Terms

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

By booking a tour with EcoWild Canada, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
